Merus GmbH - General Terms and Conditions

- 01Free trial phase without obligation: Every end customer in Germany, and on a case-by-case basis in countries with a representative, may test a Merus Ring free of charge and without obligation. The trial phase generally lasts four weeks.
- 02Rental and large applications: No free trial phase is available for industrial applications, large residential or commercial properties, or consumers in other European countries. In these cases, Merus Rings can be rented for at least six months. Approximately 80% of the rental payments made will be credited toward a subsequent purchase of the Merus Rings.
- 03a. Delivery to consumers in Germany: Delivery to consumers within Germany is free of shipping charges. For deliveries made directly by Merus GmbH to other European countries, a shipping contribution of at least EUR 20.00 will be charged together with the invoice for the Merus Ring. b. Delivery to resellers: For deliveries to resellers within Germany weighing up to 5 kg, we charge a shipping contribution of EUR 10.00. For deliveries over 5 kg to resellers within Germany, and for deliveries to resellers in other European countries, we pass on the shipping costs incurred for each shipment.
- 04a. Invoicing end customers: After the trial phase ends, Merus GmbH contacts the customer. If the customer wishes to keep the Merus Ring, an invoice is issued. If not, the customer must return the Merus Ring at their own expense. b. Invoicing resellers: For deliveries to resellers, the invoice is issued at the time of delivery with the agreed payment terms. If no payment term has been agreed, a payment period of 10 days is specified.
- 05Returns: The Merus Ring may be returned at any time during the trial phase without giving a reason. Please always return the device with postage prepaid, as a large letter, small parcel or parcel. We are reluctant to accept unpaid (carriage forward) shipments, as they cause us many times the effort and cost. The address is: Merus GmbH, Ziegelstr.1, D-71063 Sindelfingen. Telephone 07031/814084.
- 06Transfer of ownership: All products obtained through Merus GmbH remain the property of Merus GmbH until paid for in full.
- 07Warranty: You have a 5-year warranty from the date of purchase. During this period, the Merus Ring may be sent to us up to twice for a free inspection and, if necessary, recharging. The user arranges shipment to us. We bear the cost of returning it to the user within Germany. Mechanical damage or surface corrosion may make recharging impossible. These conditions apply only to Germany. Charges apply in other European countries and in countries outside the EU.
- 08Recharging after the warranty period: Inspection and recharging are also possible after 5 years and cost 35% of the purchase price applicable at the time of return. To arrange this, send us your Merus Ring with postage prepaid as a small parcel, parcel or large letter. We measure the effectiveness of your Merus Ring and recharge it after consulting you. Following paid recharging, the warranty period is renewed for another five years. These conditions apply only to Germany. Charges apply in other European countries and in countries outside the EU.
- 09Monitoring: For critical industrial processes or microbiological applications, the customer must implement performance-monitoring measures appropriate to the application so that any malfunctions can be detected in good time.
- 10Liability: Merus GmbH accepts no liability for damage to installations and/or machinery or for any resulting consequential costs.
